FSCO: Chronic Pain Removes Applicant from Minor Injury Guideline

The Minor Injury Guideline (MIG) was introduced in Ontario on September 1, 2010,  imposing a limit of $3500 on auto insurance claims for a minor injury, which can include a “sprain, strain, whiplash associated disorder, contusion, abrasion, laceration or subluxation and any clinically associated sequelae”. Despite having been introduced almost 5 years ago, interpretation of this area been challenging, as only a few written decisions have addressed the MIG.
