LIMITATION PERIOD FOR EXAMINATIONS UNDER OATH

In a recent FSCO decision, Arbitrator Murray concluded that the Insurer was precluded from conducting an examination under oath in relation to the Applicant’s claim for IRBs and HK benefits pursuant to section s.36(4)(c) as the request was made more than 10 days after the insurer received the application for the benefits. The Applicant was injured in a motor vehicle collision and applied for and was in receipt of SABS.
