The Ontario Court of Appeal recently held that insurers are not obligated to advise insureds about the applicable limitation period when denying benefits, and noted that the imposition of such a requirement is a matter for the provincial legislature. The Supreme Court of Canada may soon weigh in on the issue, since an application for leave to appeal has been filed with the top court.
