The Year of the LAT

Starting April 1, 2016, the Licence Appeal Tribunal (LAT) took over hearing Statutory Accident Benefits disputes. The first LAT decision was released online in July 2016. In a previous post, I examined the first 20 LAT decisions.

No Costs in LAT Proceeding, Despite Unreasonable Conduct from Counsel

A recent decision of the License Appeal Tribunal (“LAT”) shows the difficulty for first party insurers to get costs awarded in accident benefits proceedings at the LAT.  In 16-000546 v. Primmum Insurance Company, 2017 CanLII 46355 (ON LAT), the Tribunal considered the insurer’s motion for costs following the dismissal of the applicant’s claim.

Mother of Three Children Demonstrates Two-Fold Economic Loss to Qualify for ACBs

Haylee Tierney, Michael Tierney and Keegan Tierney, were injured in a car accident on March 17, 2013.  They applied for SABs from North Waterloo and applied to FSCO when disputes arose. Before the hearing began the parties had agreed to a partial settlement with regard to the quantum of the benefit.

Auto insurance rates rise again, putting promised cuts in the rearview

Auto insurance rates in Ontario rose again in the second quarter of 2017.

Approved rates posted by the Financial Services Commission of Ontario show an average increase of 0.76 per cent.

Last quarter, rates went up by an average of 1.24 per cent.
