Ontario pharmacists to be required to report errors

Jury awards $2,309,413 to Pedestrian who sustains Traumatic Brain Injury

In a 2016 trial, Cadieux v. Saywell, the jury awarded a severely injured plaintiff $2,309,413 in damages. The plaintiff commenced the civil action after he was pushed onto the road by another man and then struck by a truck. The driver of the truck and Mr. Saywell, the man who pushed the plaintiff, were named as defendants in the lawsuit.

Judge rules that Plaintiff’s PTSD and Depression Symptoms meet Threshold for Non-Pecuniary Damages

While the jury was deliberating at the conclusion of a 2017 trial, Nemchin v. Green, the defendant brought a threshold motion, seeking a declaration that the plaintiff had not suffered a permanent and serious impairment of an important physical, mental or psychological function as a result of the car accident and was therefore not entitled to non-pecuniary damages. The defendant’s argument centered on the issue of causation and the “but for” test for causation; specifically, the defendant asserted that the plaintiff’s PTSD and depression was not directly caused by the collision.

Ontario doctors go to court to keep billing information secret

The information and privacy commissioner last year ordered the public disclosure of the top billers’ identities, along with amounts each receives in payments from the taxpayer-funded insurance plan. The information is business-related, not personal, and should be public because of the importance of transparency of government expenditures, the ruling said.
