Law society calls for suspension of Hamilton lawyer handling Caledonia lawsuit

The Law Society of Upper Canada is calling for Hamilton lawyer John Findlay to be suspended amid an investigation into $1.5 million missing from a fund for Caledonia residents disrupted by the 2006 occupation of a housing project by members of Six Nations.

Changes reflect an early mediation trend

On May 1, 2017, there was a significant change to paragraph 57 of the Consolidated Practice Direction for Civil Actions, Applications, Motions and Procedural Matters in the Toronto Region. For all Toronto civil actions subject to mandatory mediation under Rule 24.1, court staff now require a new form of certificate to be filed in order to set an action down for trial.

It may also be necessary to use adaptive equipment (AE) to perform your ADLs. Adaptive equipment are devices that are used to assist with completing activities of daily living.

The Licence Appeal Tribunal Isn’t Unconstitutional

The Licence Appeal Tribunal isn’t going anywhere.

In 2014, the Ontario government passed the Fighting Fraud and Reducing Automobile Insurance Rates Act. Prior to this legislation, accident benefits claimants could contest a denial of benefits by filing an Application for Arbitration with the Financial Services Commission of Ontario, or commencing an action in the Superior Court. However, by virtue of this legislation, claimants lost this election as of April 1, 2016. Now claimants are required to bring their claims through the Licence Appeal Tribunal, and are prohibited from commencing an action in the Superior Court.

LAT critical of Applicant Experts Who Do Not Perform Validity Tests: H.Y. and Aviva Insurance Co.

In the LAT decision of  H.Y. and Aviva Insurance Company, LAT (16-000670/AABS), May 19, 2017, the Applicant sought entitlement to Non-Earner Benefits and a determination that the injuries she sustained as a result of a motor vehicle accident on June 5, 2015 were not minor. She also sought entitlement to two Medical Benefits, two Costs of Examinations, Interest and a Special Award.

What to do when CPP Disability Benefits are denied

Canada Pension Plan (CPP) disability benefits are intended for, and available to Canadians who have regularly made CPP contributions and are now unable to work due to a medical condition such as a serious injury or illness.  CPP disability benefits may also be paid to dependant children.  Individuals who apply for CPP disability benefits generally don’t have individual or group disability insurance, either privately or from their employer.
