Airbags change the Occurrence of Injuries

Although the mandatory wearing of seatbelts significantly reduced fatalities and serious injuries resulting from car accidents, many belted occupants were still suffering injury when their head hit the dash or steering wheel.  It is in the prevention of this type of head trauma where the introduction of airbags has played a substantial role. However, it should be noted that airbags are designed to be used in conjunction with a properly worn three-point seatbelt, and without this latter constraint, preventable injuries will continue to occur.

The high price of poverty

For many Canadians all it takes is one event, one moment, to go from getting by to living on the street or not knowing where their next meal is coming from.

For one 63-year-old Belleville resident, who asked only to be identified as Ron, that moment came when an injury to his foot sidelined him for eight months. Doctors were able to save the foot, but, by the time he was mobile again, crippling arthritis had taken root.

It’s Time to Abolish the Pain and Suffering “Cap”

Back in 1978, the Supreme Court of Canada set an upper limit or “cap” on pain and suffering damages in Andrews v. Grand & Toy Alberta Ltd. J.A. Andrews was only 21 when he was rendered quadriplegic from a motor vehicle collision. The Court wrote that “It is difficult to conceive of a person of his age losing more than Andrews has lost.” He was ultimately awarded $100,000 for his pain and suffering.

Tort Defendants Responsible for Accident Benefit Arbitration Costs

Access to justice is being denied for injured Ontario motorists as a result of the mandated use of the Licence Appeal Tribunal (LAT) as the exclusive means to resolve all accident benefit disputes given that the LAT does not allow a claimant to recover any dispute costs. But, thankfully, the courts have found a back-door way to award arbitration costs to injured motorists as part of tort cost awards.
