The puzzle of pain: Opioids are killing some, but saving others

Last week the Canadian Medical Association issued new guidelines for the use of painkilling opioid drugs: “In the battle against opioid addiction, doctors are being told to ‘put down the prescription pad’ The powerful drugs should be used only for chronic pain, primarily for cancer, and then gradually wean patients off of them.”

Bill 103: Another Slap in the Face to Injured Victims

On March 8, 2017, Ontario MPP Mike Colle introduced Private Member’s Bill 103, An Act to amend the Law Society Act and the Solicitors Act with respect to matters related to personal injury claims and client agreements in legislature.

Bill 103 set out a number of prohibitive measures including the capping contingency fee agreements at 15% of the award, banning referral fees in personal injury matters, and requiring Law Society approval of personal injury legal advertising.

Fifteen per-cent contingency fee cap won’t cover lawyers’ costs

A 15-per-cent cap on contingency fees could harm accident victims by driving plaintiffs’ lawyers out of the business, says Ottawa personal injury lawyer Victoria Boddy.

Earlier this year, Toronto MPP Mike Colle introduced a private member’s bill, the Personal Injury and Accident Victims Protection Act, that, if passed, would enact amendments to Ontario’s Solicitors Act and its Law Society Act to limit lawyers’ fees to 15 per cent of the total settlement received by their personal injury clients. The bill, which passed first reading in the provincial legislature, would also ban referral fees paid between lawyers for files.

Ontario’s Auto Insurance Industry Needs More Than a Quick Pit Stop!

Tort Defendants Responsible for Accident Benefit Arbitration Costs

Access to justice is being denied for injured Ontario motorists as a result of the mandated use of the Licence Appeal Tribunal (LAT) as the exclusive means to resolve all accident benefit disputes given that the LAT does not allow a claimant to recover any dispute costs. But, thankfully, the courts have found a back-door way to award arbitration costs to injured motorists as part of tort cost awards.
