An Ontario woman has launched a proposed class-action lawsuit against a hospital, an ophthalmologist and his assistant — who happens to be her sister — alleging a “serious and prolonged” invasion of privacy which may have potentially impacted a number of patients.

Major Canadian banks under review for business practices

OTTAWA – Canada’s financial consumer watchdog said on Wednesday it was launching a review of business practices among the country’s major banks following reports citing unnamed employees who alleged that the lenders were selling services without the consent of their customers.

$85,000 For Chronic Myofascial Pain From Three Collisions

Reasons for judgement were released today by the BC Supreme Court, Vancouver Registry, assessing damages for chronic soft tissue injuries.

In today’s case (Dhillon v. Singer) the Plaintiff was involved in three collisions which the Defendants admitted  fault for or were found liable.  The collisions resulted in chronic myofascial pain with a poor prognosis for further improvement.

When Are Conclusions of Law Made in a Summary Judgment Motion Binding on the Trial Judge?

As summary judgment motions become the more common way for parties to resolve their disputes, Ontario Courts have had to deal with the consequences of a failed motion. A recent decision of the Ontario Court of Appeal, Skunk v. Ketash, 2016 ONCA 841, answers the question of whether a judge who dismisses a motion for summary judgment has in fact made conclusive rulings of law that will later bind the trial judge.
