Law Society to set cap on amount for referral fees

A cap on referral fees was approved in principle at Convocation’s February 23, 2017 meeting. The amount of the cap, rule amendments to implement the policy, and related proposals for additional requirements to increase transparency in marketing and to ensure genuine consent in referral fee arrangements, will be considered by Convocation in the coming months.

Ontario law society cracks down on referral fees, lawyers’ ads

The meeting, made up of lawyers who are elected “benchers,” also accepted recommendations released earlier this weekby the law society’s Advertising & Fee Arrangements Issues Working Group that will give lawyers clearer guidance on what type of marketing breaks the rules — such as citing paid-for awards that are not genuine indicators of quality, or using “sexually offensive” marketing material to lure clients.

Who is responsible when a self-driving car crashes? Insurance companies aren’t sure yet

FAIR letter to Director of Arbitrations re Dr. T.

This is not a criminal case where there may be some risk to the expert witness. Recent exposure in the media regarding Ontario’s ‘expert’ evidence in auto insurance cases point to the pervasive harm and poor outcomes for claimant cases at every level of court hearings and the excessive incomes of some IME vendors. There’s been evidence of bias, medical file manipulations, forged signatures and excessive incomes relating to IMEs that have found to be so lacking in substance and honesty that Ontario’s Superior Court Justices have made negative comments in their decisions. The exposure in the Toronto Star and National Post should be viewed as an opportunity to correct the problem with expert evidence and not a reason to protect those witnesses at hearings. Whether real or not, the perception is the FSCO Arbitration Unit is protecting this insurer medical expert from accountability.
