‘Ghost writing’ prohibited in court

The idea of “ghost writing” by courtroom experts was recently addressed in a decision about defence medical assessments by insurance companies. In every serious personal injury claim, a claimant is subjected to being assessed by a host of doctors chosen by the defendant and/or their insurance company.

Car Accident Cases In Ontario – Will A Jury Help?

Few would argue that the human body is designed to withstand the forces involved in car accidents without injury. Where one party is injured through the fault of another, our legal system is designed to provide the injured person with compensation. Unfortunately, our legal system often fails to function properly where injuries are sustained in a car accident. The recent case of Mandel v. Fakhim, 2016 ONSC 6538 provides one such example.

Focus: Use of expert witnesses under scrutiny

In the nearly two years since the Supreme Court of Canada set out a framework to assess the independence of expert witnesses, there has been an increased spotlight on this kind of evidence, and subsequent lower court decisions have stressed the importance of a judge’s gatekeeper role in this area.

Why is my insurance company surveilling me?

In order to do surveillance, insurance companies hire private investigators. Insurers describe your injury to investigators so they’ll know what to look for; if you injured your knee, investigators will watch to see whether you limp. These investigators will typically search social media and various directories to learn what you look like and where you live.
