Secrecy often chockes off public information from tribunal hearings

But as mentioned in an editor’s note published last week when the Star launched its legal challenge, “tribunals appear, on the surface, no different than traditional courts — with adjudicators, hearing rooms, dockets and generally open hearings — but they depart dramatically from open court rules when it comes to providing records.”

Do you know how much commission you’re paying your insurance broker?

Over in the investment industry, they’ve been scrambling to implement new disclosure rules requiring firms to show the dollar amount of fees paid for advice, and personalized rates of return. Clients have been empowered with information that will shred some long-standing relationships with investment firms.

Retain counsel if questioned about health benefits claims

After a Toronto hospital fired 31 employees for allegedly misusing its employee benefits plan, Toronto criminal lawyer Aaron Harnett says it’s important for all workers to be aware that any statements they give to their employer about their health claims may be handed over to the police.

Reduce communication-related claims by understanding cognitive bias

Understanding cognitive biases can help reduce communication-related claims, which are the biggest source of malpractice claims. While many cognitive biases are dealt with by following some common sense principles, others are not as obvious. From anchoring effect to decision fatigue, knowing how your client makes decisions can help you build rapport with your clients, effectively give recommendations, and help ensure you and your client are on the same page.

Professionally Disabled

Such a simple question.   Ken, my new acquaintance, isn’t trying to stump me.  He isn’t trying to trick me or make me uncomfortable.  But I do feel uncomfortable, because I just don’t know what to say.

FAIR Association of Victims for Accident Insurance Reform Submission to: 2017 Pre-Budget Consultation, February 15 2017

Budgets should be about public money, economics and governance, not about enhancing Ontario’s auto insurance industry profits by downloading their costs to taxpayers. The insurance landscape in the province is in a state of chaos. The system is broken and every day more car accident victims are left behind, impoverished and without resources.
