A broken system needs fixing

For years now, the time to obtain a trial in a personal injury action has been getting longer and longer. Some courts have attempted to utilize fixed trial dates while others have used rolling settings. Neither has helped with the extraordinary delay in getting to trial and now personal injury lawyers must also deal with the Supreme Court’s decision in R. v. Appeal Court upholds a Finding of Negligence for Defendant Municipality in a Trail Biking Accident

The Municipal Corporation of the County of Bruce constructed a public park in 2005, for people to ride their mountain bikes on various trails and obstacles.  Three years after the park first opened, Stephen Campbell, a 43-year old man who was very experienced in mountain bike trail riding, fell while attempting to cross a constructed obstacle called ‘Free Fall’.
