Toronto judge halts charges against man until government pays for lawyer

A Toronto judge has criticized the income cutoff for legal aid funding in Ontario as “not realistic” given the face of poverty in Canada.

[6]          In order to initiate a valid claim for SABs, each SABs claimant signed and submitted to the plaintiffs a standard Application for Accident Benefits (OCF-1). The applicable provisions concerning consent are set out at Part 12. Each SABs claimant has expressly consented to the plaintiffs’ collection, use and disclosure of their personal information and PHI for the legitimate purposes of, inter alia, investigating and processing their claims, obtaining or verifying information relating to their claims in order to determine entitlement and the proper amount for payment, recovering payment from insurers and others liable in law for amounts that the insurer pays in connection with their claims and preventing fraud and detecting fraud where there are reasonable grounds to suspect fraud.

June 1 and the hefty cuts to auto insurance benefits plus a redefinition of what is catastrophic, working against someone who is catastrophically injured, came into effect. We are told that our premiums are going down. The catch is that they are only going down for some (7%) max so far, but benefits are also down. Nice way to finance the premium reduction for those with perfect driving records. Libby Znaimer of Zoomerradio, with her program, “Fight Back”, had me on her show yesterday to give an opinion other than what an insurance broker would represent.
