Injury Claim Dismissed Following Collision That Was “Impossible” To Recall

In today’s case (Havens v. ICBC) the Plaintiff was involved in a 2010 motorcycle collision.  He sustained a brain injury.  The Plaintiff alleged that the collision was caused through the careless actions of an unidentified motorist operating a red truck.  The Court dismissed the claim finding it was not proven, most notably accepting medical evidence that the plaintiff’s recollection was medically ‘impossible‘ given the nature of his head injury.

Advocates plead to save program that pays bills for people in need

The program’s proponents say it has kept many people in danger of being homeless in warm apartments and off the streets. Now there’s no money for it, and the program will end this spring.

Jevco Insurance Company v Pacific Assessment Centre Inc., 2015 ONSC 7751 (CanLII)

[3]               This action alleges an elaborate insurance fraud scheme.  Jevco Insurance Company (“Jevco”) is an automobile insurer and as such provides statutory accident benefits to its insureds.  The various defendants operate centres that purport to provide medical assessments, rehabilitation services, and other treatments for individuals who are injured in automobile accidents.  Jevco alleges that from August 2009, and possibly earlier, the defendants submitted fraudulent assessments and claims to Jevco, causing Jevco to improperly pay over $500,000.  Jevco commenced an action claiming: $2 million in damages for fraud, fraudulent misrepresentation and/or unjust enrichment; $2 million in damages for conspiracy; and $2 million in aggravated and/or punitive damages.

Auto Insurance Update: More Cutbacks are Coming

The Ontario government has announced significant changes to the auto insurance system effective June 1, 2016. As of that date, the following changes will further reduce the limits of insurance available to persons injured in motor vehicle accidents (including most cars, trucks, motorcycles, snowmobiles, ATV’s, etc.)

FSCO Publishes Q4 2015 Rate Changes Data

The Financial Service Commission of Ontario (FSCO) released new data last week that showed details regarding 21 auto insurance providers in the largest insurance market in Canada. Those 21 insurers represent more than 51 per cent of the auto insurance market in Ontario reveals that shows filings approved during the final three months of 2015 resulted in an average 0.15 per cent decrease when compared across the total market.

Ottawa working on “options regarding next steps” for Canada-wide mandatory privacy breach notification

Before the House of Commons was dissolved last summer to kick off the federal election, the ruling Conservatives passed the Digital Privacy Act, which creates new offences for failing to report data security breaches. However, nation-wide mandatory breach notification would not actually take effect unless the government develops regulations, and it is not clear whether the newly-elected Liberals plan to do this.

Ontario appeal court restores arbitrator’s fault ruling

In reinstating an arbitrator’s original award and overturning a Superior Court of Justice order for a 50-50 fault-split, the Court of Appeal of Ontario has reaffirmed the Fault Determination Rules chart used in insurance matters should override any application of the ordinary rules of tort law.
