Reduction in prejudgment interest rate in Ontario auto lawsuits applies retrospectively: Court

A reduction two years ago, in Ontario’s prejudgment interest rate for pain and suffering damages awarded in auto bodily injury lawsuits, was intended to apply to lawsuits arising from vehicle collisions before 2015 if they go to trial after Bill 15 took effect, the Court of Appeal for Ontario has ruled.

Ontario court decision on insurance limitation periods is one to watch

The Ontario Court of Appeal recently held that insurers are not obligated to advise insureds about the applicable limitation period when denying benefits, and noted that the imposition of such a requirement is a matter for the provincial legislature. The Supreme Court of Canada may soon weigh in on the issue, since an application for leave to appeal has been filed with the top court.

Federation of Ontario Law Associations advises LSUC be careful in its contingency fee review

The Law Society of Upper Canada (LSUC) has been in consultation since June over issues with contingency fee agreements and now feedback from the profession is starting to come in.

The Federation of Ontario Law Associations (FOLA) has taken a stance and is advising the law society use caution in its review as it believes problems for lawyer-client relations could arise if the LSUC puts certain rules in place.
