“Opportunistic” MVA Plaintiff Misses Deadline to Sue for Damages

In a recent motor vehicle accident case, the court rejected the plaintiff’s late-breaking switch in litigation strategy as “opportunistic”.  Instead, it allowed the defendant to amend his court pleadings a full two years after the accident, which potentially shut out the plaintiff’s personal injury claims entirely.

Insurance brokers and the Government of Ontario have failed Ontario drivers by not educating them about what changes were made to accident benefits and accident benefit limits beginning in 2010 and moving forward. Sadly, I see injured people every day who are left struggling to make ends meet because they don’t have adequate coverage to recover from their car accident injuries. They assumed that when their broker renewed their car insurance the broker had their needs in mind, not those of the insurance companies.

Supreme Court decision reduces mental illness stigma

In the case, the nation’s top court ruled in favour of the plaintiff, a B.C. tractor-truck driver injured in a collision with another vehicle. Granting his appeal, the Supreme Court restored a trial judge’s decision to award the man $100,000 in non-pecuniary damages, despite his failure to offer evidence of a medically recognized psychological illness.

Ontario relaxes rules on supports for people with disabilities

TORONTO — Ontario residents with disabilities are seeing major changes to provincial programs offering financial support and medical coverage.

Effective Friday, the government is loosening some of the stringent rules governing the Ontario Disability Support Program (ODSP) and Ontario Works (OW). The two are the primary social support systems for disabled residents, although Ontario Works assists non-disabled residents as well.
