ODSP exemptions benefit disabled accident victims

Disabled accident victims who are in receipt of ODSP benefits will no longer have to worry about income support clawbacks after changes to the Ontario Disability Support Program (ODSP), says Ottawa personal injury lawyer Najma Rashid.

Before this month, individuals receiving ODSP benefits would have to declare compensation awards for pain and suffering worth more than $100,000, as the province counted any amount above that as an “asset” under the program.

Mandamin v. Pafco: You cannot SOLELY dispute a CAT denial at the LAT

In the decision of Mandamin v. Pafco Insurance Company, released on July 31, 2017, an Arbitrator at the Financial Services Commission of Ontario (“FSCO”) held that the Licence Appeal Tribunal (“LAT”) does not have the jurisdiction under s. 280(1) of the Insurance Act to hear an Arbitration that solely involves a dispute over whether or not an insured is catastrophically impaired (“CAT”).

New ODSP limits better, but not good enough, say advisors

Starting September 1, Ontarians with disabilities will have more — but perhaps not enough — flexibility when it comes to their finances. Previously, single recipients of the Ontario Disability Support Program could only receive $6,000 in gifts in any 12-month period. Ontario has increased the amount to $10,000, which some advisors say is still insufficient.

Ontario’s Marshall Report: The Illusion of “Fair Care”

As a psychologist who provides treatment for people who have psychological issues arising from auto accidents, I was interested in reading the recently released report by David Marshall, which was commissioned in 2016 by Ontario’s Wynne government to review the Auto Insurance System in this province.
