$50,000 Non-Pecuniary Assessment for Aggravation of “Active Back and Neck Pain”

In today’s case (Dhaliwal v. Pillay) the Plaintiff was involved in two collisions, the first in 2010, the second in 2011.  The Defendants admitted fault for both crashes.  Prior to the collisions the plaintiff fell off a ladder and injured his neck and back and had ongoing symptoms from this injury.  The Court found the collisions aggravated these pre-existing injuries.

Facebook is watching you even if you don’t have Facebook, claims study

It’s claimed that Facebook tracks the internet usage of people who don’t have a Facebook account. The Guardian reports that the study; by the Vrije Universiteit Brussel and the University of Leuven’s Centre of Interdisciplinary Law and ICT; claims that the social network tracks every visitor to pages on its site even if they have opted-out of tracking, have logged out of Facebook, or do not even have an account.

Calculating Future Care Costs

The law in Ontario provides that a person or company who causes an injury must pay the injured person any extraordinary care costs related to the injury. Past care costs are relatively simple to calculate. A more difficult issue is calculating future care needs. How are these costs calculated?

In his riveting tale of how psychiatrists “medicalize” human suffering, Gary Greenberg recounts that, in 1850, a physician called Samuel Cartwright reported a new disease in the highly respected New Orleans Medical and Surgical Journal. Cartwright named it drapetomania, from the ancient Greek drapetes for a runaway slave; in other words, here was a disease that “caused Negroes to run away.” It had one primary diagnostic symptom — “absconding from service” — and a few secondary ones, including “sulkiness and dissatisfaction just prior to flight.”
