Auto collision lawsuit defendants’ use of video surveillance evidence without disclosure in affidavit breached civil procedure rules, Ontario appeal court rules

The Court of Appeal for Ontario has overturned an earlier decision in a lawsuit arising from an auto collision, finding that the defendants breached the province’s Rules of Civil Procedure in making a video of surveillance of the plaintiff an exhibit – and cross-examining the plaintiff on its contents – without having disclosed the existence of surveillance in an affidavit of documents.

When a person is seriously injured as a result of a motor vehicle accident, costs for medical, rehabilitation, and attendant care services are often substantial. In most cases in Ontario, those who suffer a catastrophic impairment are able to access up to $1,000,000 for medical and rehabilitation benefits and up to $1,000,000 for attendant care benefits through accident benefit claims with their own automobile insurer.

The doctors are not being told to cut patient visits short.

How Simple Mistakes Can Lead to Large Claims

It’s easy to think that, at least in your office, a major claim couldn’t possibly happen. But LAWPRO’s experience shows that errors, innocent oversights and gaffes in any type of practice can lead to big problems. And if you or your firm don’t have adequate insurance in place to address the claim, you could be facing personal exposure. The number of LAWPRO claims with values that exceed $100,000 has risen sharply in recent years and often the mistakes that lead to such claims result from very simple errors.
