Bias a hot topic for experts as Getahun debate continues

Bias is once again the hot topic among expert witnesses after an Ontario Superior Court judge banned lawyers from meeting with their experts to review draft reports.

Justice Janet Wilson ignited a firestorm with her January decision in Moore v. Getahun, a ruling currently under appeal. Meanwhile, the Supreme Court of Canada will also tackle the issue of expert independence this fall when it hears arguments in the Nova Scotia case of Abbott and Haliburton Co. v. WBLI Chartered Accountants.

ON Court of Appeal Divided in Accident Benefits Nexus Case

In a 2-1 split, the Court of Appeal for Ontario has allowed an insurer’s appeal of a priority dispute case deciding whether any insurer of any kind, or only “motor vehicle liability insurers”, are obliged to pay accident benefits pending the resolution of a priority dispute.

Ontario election call leaves auto changes in limbo

THE ONTARIO election call has left auto insurance reform legislation there in limbo — a turn of events that pleases critics of one of the bills while supporters are now clinging to the hope it will be revived no matter who runs Queen’s Park after the June 12 vote.

FAIR, the Association of Victims for Accident Insurance Reform, is relieved that the bill is being set aside. “This was a bill that our Liberal government was ramming through without adequate consultation or consideration for Ontario’s auto accident victims,” chair Rhona DesRoches said. “On April 30th this government allowed only two hours to consult with stakeholders on an issue that affects millions of Ontarians and represents billions of dollars in our economy.”
