Unidentified car claim: Court seeks ‘science’ in expert report

The Supreme Court of British Columbia has tossed out the report of a forensic engineer, which supported the public insurer’s position in an unidentified car case, saying the report relied too heavily on expert opinion and not enough on “science.”

There’s Nothing Fair About Ontario’s “Fair Auto Insurance Plan” For Accident Victims

Earlier this week the Ontario Government announced new proposed legislation to address auto insurance called “Ontario’s Fair Auto Insurance Plan”. This newly proposed legislation – the government claims –  will once and for all tackle high insurance premiums.  You have heard that promise before, repeatedly.   It’s perhaps no surprise that the Insurance Bureau of Canada, a national lobby group for insurance companies welcomes the latest changes.

Memo to bullying doctors: Heal thyselves

It’s not realistic to expect the CPSO leadership, a good many of whom are either doctors or were elected by doctors, to put their primary focus on the public rather than physicians. It’s particularly noticeable when patients who have allegedly been abused by doctors bring complaints to the CPSO, which in many cases seems to close ranks to protect the physician.

Litigation costs lead to systemic inequality for road violence victims

Litigating on behalf of victims who have suffered road violence is becoming very difficult in the present legal climate. The financing of claims has become increasingly more expensive and well outside of what the ordinary litigant can afford. However, the same does not apply to insurance companies, which have the means to litigate their cases against the seriously injured. Even more important, medical/legal and other crucial expert reports are growing in cost each year.

WSIB to abolish policy that slashed benefits for thousands

The provincial workers’ compensation board will reverse a controversial policy that slashed benefits by blaming injuries on “pre-existing conditions,” even if they had no physical impact on workers before they got hurt on the job, the Star has learned.

B.C. reviews list of doctors who can assess auto-injury victims

British Columbia is the second province to review how auto-accident victims are assessed after The Globe and Mail identified problems with the practice across the country.

The province’s public insurer, the Insurance Corporation of British Columbia, says it is reviewing the list of doctors who can assess accident victims – and says it has already removed one doctor from the roster.
