Legal Matters: Can I still receive Ontario Disability Support Payments if I win a lawsuit against the at-fault driver?

I am receiving Ontario Disability Support payments (ODSP).  I was involved in a car accident that was not my fault and I have sued the at-fault driver.  Will a settlement of my lawsuit affect my receipt of ODSP benefits?

My leased car was in an accident. Do I have to keep making payments?

After a crash, payments don’t stop just because your car can’t go.

If your car is in the repair shop, you have to keep paying your financing or lease payments until it’s fixed and you can drive it again.

Can I File an Injury Claim for Whiplash?

There are a variety of injuries that can result from a car accident, one of the most common of which is whiplash.

This soft-tissue injury of the neck occurs when the head and neck are jerked in one direction and then another in a whip-like motion. For instance, if you are struck from behind by another vehicle, your body will begin traveling in a forward motion before coming to an abrupt stop, whipping your head and neck to a stop as well.

Court weighs in on self-represented litigants

Lawyers say a recent Court of Appeal decision illustrates the challenges trial judges can face when presiding over matters with self-represented litigants, as well as the responsibilities justices owe them.

In Moore v. Apollo Health & Beauty Care, the court found that a Small Claims Court judge had not “made sufficient inquiries” before concluding a self-represented litigant had abandoned part of her claim — resulting in an unfair trial.
