Insurance is one of those things that you have to purchase, despite the fact that you hope to never use it. And when you do have to use your insurance, it’s because something bad has happened: you were in an accident, your car was stolen or damaged, or maybe you were a victim of vandalism. Needless to say, making an insurance claim probably isn’t your idea of fun, so here are some ways you can make it easier on yourself.

Toronto Region has decided to continue the Toronto Sittings Project on a permanent basis for all motor-vehicle and personal injury jury actions (excluding medical malpractice) that are 2-3 weeks in length. Going forward there will be 2 sittings; classified as Spring and Fall. The sittings correspond with the month of June and the month of October, respectively, and will continue on a yearly basis.

In Thomson, Justice Firestone presided over a case conference requested by the plaintiff in a situation where the defendant refused to schedule mediation until after examinations for discovery were complete. The purpose of the case conference was to request that a timetable be imposed. Justice Firestone commended plaintiff’s counsel for properly requesting the case conference pursuant to Rule 50.13.

Since becoming Premier, Kathleen Wynne’s focus on the auto insurance file has been to bring down rates. The government originally set a rate reduction target of 15%. After several years, the target was quietly abandoned. The government has done a lot of tinkering with the system without providing much rate relief to Ontario drivers.
