1. Can you describe some of the circumstances that one would be looking for third-party litigation funding?

“Law firm financing would apply to situations where lawyers provide legal services on a contingency fee basis. Personal injury lawyers will tell their clients, ‘I’ll take on your case on a no-win, no-fee basis. If I’m successful, I get paid and my pay will be a percentage of the damages. If I’m unsuccessful, I get paid nothing. I will also fund the disbursements in litigation and if I’m successful I get those back and if I’m unsuccessful, I don’t.’ Contingency fee retainer arrangements are invariably used in personal injury and class-action cases.

Decision erodes access to attendant care benefits

A recent arbitration decision could effectively deny accident victims access to attendant care, Ottawa personal injury lawyer Najma Rashid tells AdvocateDaily.com.

In the Licence Appeal Tribunal (LAT) case, the arbitrator ruled that an insurer only had to pay for care according to guideline hourly rates for professional services, some of which are below minimum wage.

Applicant Clearly Meets CAT Designation

Ms. Bindu Patel was injured in a car accident on February 17, 2014 when she was driving to work. She was stopped and hit from behind causing her to crash into the car in front of her. She was taken to the hospital and diagnosed with soft tissue injuries, however shortly afterward her mental condition started to be affected and it deteriorated significantly to the point where she did not like to be alone, started hearing voices, and has been unable to return to work.  Ms. Patel sought SABs from Unifund, however when they were unable to resolve their disputes she applied to the FSCO for arbitration.
