Barring drivers would revolutionize the civil jury pool

An attempt to bar drivers who pay insurance from serving on civil juries would revolutionize the system as we know it, Ottawa personal injury lawyer Howard Yegendorf tells AdvocateDaily.com.

In an ongoing personal injury case, the plaintiff brought a motion to exclude drivers who pay premiums from the jury pool altogether, arguing that the possibility a large damages award could cause a hike in their own rates places them in an inherent conflict of interest.

McLeish hopeful Sittings Project can relieve civil trial delays

Toronto critical injury lawyer John McLeish says he’s cautiously optimistic a pilot scheduling project could improve crippling delays in the civil justice system.

The Toronto Sittings Project aims to cut delays in scheduling by switching all two- or three-week personal injury jury cases to month-long sittings.

Long-Term Disability Insurance Claim Denied? Here is What to Do Next

One of the most frustrating things after suffering an injury and applying for long-term disability insurance is having your claim denied.

After going through the lengthy and time consuming process of filing for long-term disability benefits, receiving a letter stating your denial can be very discouraging. It’s very important in this situation to not give up, or take this outcome personally. You also shouldn’t blame anyone for your denial.

Unidentified car claim: Court seeks ‘science’ in expert report

There’s Nothing Fair About Ontario’s “Fair Auto Insurance Plan” For Accident Victims

Earlier this week the Ontario Government announced new proposed legislation to address auto insurance called “Ontario’s Fair Auto Insurance Plan”. This newly proposed legislation – the government claims –  will once and for all tackle high insurance premiums.  You have heard that promise before, repeatedly.   It’s perhaps no surprise that the Insurance Bureau of Canada, a national lobby group for insurance companies welcomes the latest changes.

Memo to bullying doctors: Heal thyselves

It’s not realistic to expect the CPSO leadership, a good many of whom are either doctors or were elected by doctors, to put their primary focus on the public rather than physicians. It’s particularly noticeable when patients who have allegedly been abused by doctors bring complaints to the CPSO, which in many cases seems to close ranks to protect the physician.

Litigation costs lead to systemic inequality for road violence victims

Litigating on behalf of victims who have suffered road violence is becoming very difficult in the present legal climate. The financing of claims has become increasingly more expensive and well outside of what the ordinary litigant can afford. However, the same does not apply to insurance companies, which have the means to litigate their cases against the seriously injured. Even more important, medical/legal and other crucial expert reports are growing in cost each year.
