Law Society to set cap on amount for referral fees

A cap on referral fees was approved in principle at Convocation’s February 23, 2017 meeting. The amount of the cap, rule amendments to implement the policy, and related proposals for additional requirements to increase transparency in marketing and to ensure genuine consent in referral fee arrangements, will be considered by Convocation in the coming months.

Ontario law society cracks down on referral fees, lawyers’ ads

The meeting, made up of lawyers who are elected “benchers,” also accepted recommendations released earlier this weekby the law society’s Advertising & Fee Arrangements Issues Working Group that will give lawyers clearer guidance on what type of marketing breaks the rules — such as citing paid-for awards that are not genuine indicators of quality, or using “sexually offensive” marketing material to lure clients.

Law Society limits referral fees and strengthens advertising rules in the public interest

TORONTO – Today, the Law Society’s governing body, Convocation, agreed to cap and further regulate the fees a lawyer or paralegal may charge for referring a client to another licensee. A cap on referral fees was approved in principle. Rule amendments to implement the policy, and related proposals for additional requirements to increase transparency in marketing and to ensure genuine consent in referral fee arrangements will be considered by Convocation in the coming months.
